The present research focused on deposit contract because it is one of the common contracts in the ancient Iraq. This kind of contract regulated important aspects of economic activities in that period. The ancient Iraqis knew the deposit contract and they regulated its dispositions. They also put its forms in order to include precious things, jewelleries, cereals, corps and slaves. Sometimes traveling abroad, insecurity, internal conflicts and wars are the reasons which obliged people to search for trusted deposit to put their money and their savings , they had to find a priest or a merchant or a reliable person. At that time, ancient Iraqis were aware of deposit with pay and deposit without pay. They also put dispositions and regulations for the deposit as it is the case nowadays. Perhaps the diversity of deposit contracts in the old Babylonian period reveals the evolution of the Old Babylonian society in all fields of economic and social development. When comparing the provisions of the contract deposit in the Old Babylonian society with these in force in the modern laws in force, we find that it does not differ substantially from the protection provided for all those that were provided by the old Iraqi laws.
We could even say that the laws of the ancient Iraqis are similar to those prevailing in our modern time they protect the rights of the contracting parties. In fact, we cannot find substantial differences between the organization of a deposit contract in that time and the present in spite of the fact that the Old Babylonian laws were passed more than five thousand years ago
